I believe this incident was absolutely staged by the government, especially in a climate where people hold a very negative view of the mullahs and are fed up with their rules. Isn’t it ironic that the government released the full footage, perfectly angled, just a day after showing the cut version? Every Shia Ayatollah who wants to become a ''religious leader''(or a "'Marjae Taghlid''), someone who is able to give religious advice to others, has to write an extensive religious text called a ''Resaleh'', and in it explain his own opinion concerning religious, ethical, philosophical, social and political matters. In this text a lot of ''possible scenarios'' are considered, and a lot of questions are answered on how a good Shia should deal with those scenarios if they ever do happen. 

This ranges from simple matters like what should one do during Ramadan if he's a traveler, to complicated things like how to deal with people from other religions, to ridiculous things like what you should do if you fart during prayer or have an erection while reading the Qoran!  

Khomeini was both a Grand Ayatollah and a Marjae Taghlid, so he had his own "Resaleh'', which is very elaborate and extensive. To non-Shia Muslims some of the things in his Resaleh might sound ridiculous. some of it might sound bizarre and some of it will sound other-worldly. I am Shia but I don't follow Ayatollah Khomeini as my mentor,however I have read some of his Resaleh and to answer your questions one by one :

To understand this perfectly, you must consider the differences between a bad act, the law, and a ''sin''. Sin is a bad act you commit against God and his will, it is a religious concept. Bad behavior is something you do to other people that is not acceptable under the ethical belief system and cultural climate you live in, or that is hurtful to others. Law, is a government mandate for how you should behave based on legal considerations. Opium and other narcotics are illegal in Iran, and people dealing more than a certain amount of it will be executed by the government, using them is also a social stigma and is not considered ''good'' or ''acceptable''. So it's not good, it's not legal, but is it a sin against God and his true prophet? Each Ayatollah has a different answer. Khomeini thought that even though narcotics are socially destructive and using them is a morally reprehensible thing to do, it cannot be considered a sin because sin is by nature determined by God. 

Using opium and other drugs is not considered a sin in Islam because when Muhammad (s) was chosen by God to become a prophet these things did not exist.

Confess to God, pay some fine to the owner of the animal and pay a fine to the local mosque, was Ayatollah Khomeini's answer. Some misguided and judgmental people took this as ''Khomeini is saying pay some money and go fuck a goat, look at this depraved pervert''. But of course this is not true or fair. 

An Ayatollah has a moral responsibility and a religious duty to answer every single question that a believer might have from him, a Resaleh is a thick book filled with these questions and the author's answers to them. So he's not saying ''Mmm yes, let's go fuck some goats right noaw'', he's saying ''what if someone fucks a goat..'

Some of our kafir friends have had great times trolling these pious old men with questions like ''what if I sit on a spoon and it ends up my rectum'', ''what if I accidentally marry my mom?'', ''what if I piss out of my ass one day and it ends up in my mouth?'', ''what if alines come to earth and I fuck one of them, is it halal?''... The kafirs do this for several reasons: to mock our faith and show how ''silly'' we religious folks are(and how enlightened they are), to give the less intelligent fedora tippers something to mock us instead of having a civilized discourse, and also because it's ''fun'' to mess with the holy. 

And they have answered them all! In fact you can ask these questions from most Grand Ayatollah's online, and they will answer almost all of them no matter how ridiculous they might sound.

As to what the BBC article says, it's a report on a statistical claim that "child marriage" has increased in Iran. The article states that child marriage is defined as marriage of any person under the age of 15. Another source in the article counters that while these marriages do happen in Iran, they are actually decreasing, not increasing. The first paragraph of the article summarizes the dispute.

The article explains that according to the law in the Islamic Republic of Iran, it is illegal for anyone under the age of 15 to marry. However, loopholes have been found to this law by applying for special exceptions.

It says that the reason for such marriages is mainly poverty and also cultural problems, and that underage marriage doesn't just happen to girls, but boys as well (although less frequently).

The article actually says nothing about Khomeini whatsoever. The statistics on these underage marriages were gathered by the Iranian government itself, apparently.

I don't have first hand sources--I have only heard about these issues.

In America he was commonly derided for "allowing" sex with animals. This is a reference to an incident when he was a jurist, in which he presided over a case regarding a man who had committed a crime by having sex with an animal. If my memory serves correct, he ruled that the man not be punished (or punished very lightly?) and that the animal should be put to death (and not eaten). His instructions on what to do to resolve the case were widely mocked and ridiculed as "allowing" bestiality. Honestly, what *should* he have done? Ordered the man be jailed? Beaten?

The issue of underage sex is less clear and I've rarely heard it spoken about except by very very extreme anti-IRI people. That doesn't mean they're wrong (possibly they are the only ones who dare to bring it up)--it's just not a usual conversation starter.

Traditional Islamic law requires consent to marriage. To give consent to marriage you must have reached the "age of maturity", which was basically considered to be the onset of purity. This is the kind of shariah which westerners like to call medieval, since modern notions of adulthood don't begin with puberty, but rather being 18 or some nonsense. The age of consent for sex is lower than 18 in a lot of countries--in the US in certain cases you can get married at 13. But anyway in old times Islamic scholars reckoned that boys reached maturity at around 13 and girls at around 9.

So, what I heard from a close friend is that, Khomeini somewhere explicitly allowed that if a man gets married to a girl young than 9, he is forbidden from having sexual intercourse with her, but they are allowed to engage other sexual acts that basically don't involve penetration (like grinding).

To be honest I'm not sure if the idea of being "betrothed" has any legal merit in Islamic tradition, and yes the age of consent (to marry) was traditionally rather young by today's standards, but I don't see how it's at all possible for any person to legally marry before reaching the age of consent in Islamic law. If Khomeini allowed this, it seems kind of whack.

I have, however, heard of families allowing temporary marriages with babies or children in order to allow the child's female relatives to be seen without hijab by the man. These kind of marriages contain a specific provision that forbids sexual activity. Even so, it's kind of a stupid/pointless loophole that may simply be unique to Iranian culture (I've never heard of this anywhere in Islamic law or outside of Iran). It's possible Khomeini was attempting to give a "liberal" ruling by saying that yes, *sex* is forbidden, but if something is technically not sex then it's technically not forbidden.

Anyway this is just conjecture. It would be interesting to see evidence on what exactly he said or if he ever said anything about these topics.

The main thing you need to know is that Khomeini's religious treatises are written in his capacity as a Muslim jurist, not a political leader. Jurists don't 'approve' of things. Their job is to say what's permitted and what is not. The decrees Muslim jurists provide follow this general formula: "according to what I have found/not found in sources X, Y, Z, and so on the act you have asked about is permitted/prohibited/preferable to avoid/preferable to commit; and Allah knows best."

If you are going to fuck sheep, Khomeini is not going to stop you. It doesn't matter to the society. He has not found prior reliable text that permits or prohibits it. He has not found text that prescribes or proscribes it. (Probably because nobody was weird enough to ask this sort of question from a jurist in the past.) That's his job as jurist. Therefore, it's 'permitted' and left to your own discretion, medical knowledge, compassion, and secular law--per *other* decrees which require you to take care of your health, have compassion for animals, and follow the laws of the land that do not contradict the school of fiqh you follow. It is not 'approved of' or 'preferable to commit.' It is 'preferable to avoid' but it is not 'prohibited.'

In the issue of age of consent there's a general condition of physical and emotional maturity of the person, male or female, stated in all books of Islamic jurisprudence. Muslim jurists' decrees set a nominal minimum and then leave evaluation of maturity to the society and individuals. A Muslim country's legal system cannot go *below* the nominal minimum but it can raise the legal minimum following the social circumstances.

In Iran marriage earlier than what's common in urban areas occurs mostly in tribal communities. These are usually against the law of the land and, if you go by Khomeini's religio-political stance, are therefore 'prohibited.' However, many of the tribal communities these occur in are not followers of Khomeini as a Muslim jurist. Most are Sunni groups following their own schools of fiqh. In some rural areas in central Iran there are also Shi'a followers of other jurists who may have early marriages.

In short, no, Khomeini did not drop from the rear end of the sky to encourage you to fuck sheep and marry 9 year old girls.

(If anything the current [average age of first marriage in Iran is 27.4 for males and 22.1 for females](https://en.wikipedia.org/wiki/Age_at_first_marriage) which some people believe to be a sign of social distress.)
